OFFICIAL RULES FOR FANTASY SPORTS HOURTM PATENT PENDING
1. What is FANTASY SPORTS HOUR:
FANTASY SPORTS HOUR is a fantasy sports game that takes
place during a designated period of time, typically 60 minutes in length ("Contest"). Prior to the Contest,
entrant chooses six athletes from a list of eligible players, from one or more sports, scheduled to be played
during that time period. During the course of the fantasy game athletes are assigned points for plays that
they complete. At the end of the time period, the entrant with the most points wins.
FOR THE ONLINE GAME SITE, THIS PROMOTION IS INTENDED FOR PLAY ONLY WITHIN THE UNITED STATES (AND THE DISTRICT OF COLUMBIA). THIS PROMOTION IS STRICTLY FOR ENTERTAINMENT PURPOSES AND MAY NOT BE USED IN CONNECTION WITH ANY FORM OF GAMBLING.
2. Open an Account:
Before you can enter any FANTASY SPORTS HOUR contest, you must register. To enter a fee-based FANTASY SPORTS HOUR contest, you must open an account and add money to it.
Sponsor may offer promotional credits from time to time. These promotional credits must be used to play Fantasy Sports Hour contests and may not be redeemed for cash. Limited to one promotional credit per household. Valid email address required for redemption of prizes won.
3. Choose Which Contest to Enter:
Listed on the FANTASY SPORTS HOUR page are all currently available Contests. Contest description will include tournament size, entry fee, prizes, contest time and
whether athletes are from one or multiple sports. Once you have found the Contest you want to play, click 'VIEW'.
4. Enter Your Team:
Enter your six players in accordance with the player roster and entry deadline rules for the selected contest. Only players listed for the selected contest may be chosen. Participants may NOT choose all players from one team. Entries identical to prior entries for the same contest will not be allowed.
5. WIN PRIZES/RETAIL VALUE:
Rules of Play: During the course of the time period athletes are assigned points for plays that they complete. Plays are registered when the play statistics arrive at our servers, so plays occurring at the end of the time period may not count during that time period. At the end of the time period, the entrant with the most points wins. In case of entrants having identical point totals, the entrant who has chosen players in order of highest individual performance wins. In the case of entrants having the same point total and the same order of highest individual player point totals, the entrant that has the first issued ticket (Universal Time) wins. 6. Watch Live Scoring:
Once the entry deadline for the selected Contest passes you can watch your team's performance based on the scoring rules defined for the selected Contest. If you did not submit your player roster by the specified entry deadline, you will receive no points.
7. Win Prizes:
After the selected contest ends, prizes will be awarded by 5:30 PM ET the following day. One 1st Place prize is awarded per contest. All prizes are added to your account balance.
8. Multiple Teams and Incomplete Contests:
There is no limit to the number of contests that you may enter, but you are limited to one team per contest. If a contest does not have enough teams at the entry deadline, the contest will be dissolved and the entry fee will be refunded to your account balance.
9. Canceled Games:
If a game scheduled as part of a contest is not played (i.e., , a baseball game listed in a contest is rained out), it will be removed from the contest's scoring and only the remaining games will be used to calculate scoring and determine the winner. However, all scoring occurring prior to the cancellation of a game will be included in the contests scoring (i.e. if a baseball game is cancelled after 3 innings of
play, the scoring occurring during the 3 innings will count in the contests scoring).
ELIGIBILITY AND ENTRY
Open to legal residents of the United States (excluding Puerto Rico, US Virgin Islands and US and foreign possessions and territories) and Canada (excluding Quebec) who have reached the age of
majority in their states or provinces and had Internet access on or before date of the contest, and are located in the United States (excluding Puerto Rico, US Virgin Islands and US and foreign possessions and territories) or Canada (excluding Quebec) at the time of entry.
NO PURCHASE NECESSARY TO PLAY A NO-FEE GAME. VOID IN PUERTO RICO, US VIRGIN ISLANDS, US AND FOREIGN POSSESSIONS AND TERRITORIES, QUEBEC AND WHERE PROHIBITED. Residents of Ineligible Locations (as defined below) may play the Game but are NOT eligible to win or receive prizes. The Game is not to be used in connection with any form of gambling or for the promotion of gambling.
Eligibility
Open to legal residents of the United States (excluding Puerto Rico, US Virgin Islands and US and foreign possessions and territories) and Canada (excluding Quebec), who have reached the age of majority in their states or provinces and are located in the United States (excluding Puerto Rico, US Virgin Islands and US and foreign possessions and territories) or Canada (excluding Quebec) at the time of entry. Residents of Arizona, Iowa, Louisiana, Maryland, Montana, Vermont, and the province of Quebec (collectively, the "Ineligible Locations"), who have reached the age of majority may play, but are NOT eligible to win or receive any prizes. Any individual who is resident in the United States or Canada (other than the Ineligible Locations) and who is at least 18 years of age as of date of contest, but has not reached the age of majority in his/her state, province or territory of residence, may register to play the Game, provided he/she has his/her parents permission, but will NOT be eligible to win or receive any prizes. Employees and their immediate families, including household members, of MoGold llc, Stats, Inc., Fanball and/or of each of their respective parent companies, subsidiaries and affiliates, and of their respective distributors, suppliers, participating vendors, promotion or advertising agencies, or of any other company or person involved with the design, production, execution or distribution of the contests (collectively, Sponsor's "Promotional Partners") are not eligible to enter.
Entry Entrants will go to the official Fantasy Sports Hour website and view the next available Contests. Some Contests are free, while others have different entry fees listed in US dollars. When you select to participate in the next Contest, for Fee Based Contests, that amount of US dollars will be removed from your Fantasy Sports Hour account. Then, follow the links and instructions provided for entry. In the event of a dispute regarding the identity of the person submitting an entry, the entry will be deemed submitted by the person in whose name the email account was registered. ALL PAYMENTS ARE FINAL. NO
REFUNDS WILL BE ISSUED.
CONDITIONS OF PARTICIPATION
By entering a Contest, entrants agree to be bound by these rules and decisions of Mo Gold llc Sponsor, which shall be final and binding in all respects. By entering a Contest, where legal, by being an entrant or winner, you consent to the use of your name, voice, and likeness, photograph in and in connection with the development, production, distribution and/or exploitation of the Contest. Winners agree that from the date of notification by Sponsor of their status as a potential winner and continuing until such time when Sponsor informs them via writing (including email) that they no longer need to do so, that they will make themselves exclusively available to Sponsor or its designees for publicity, advertising and promotion activities, and must agree not to allow interviews by other media outlets, including television, magazines, newspapers, radio and Internet, unless authorized by Sponsor. Sponsor and Sponsor's Promotional Partners reserve the right to make public personal information about the entrants and winner(s), on-air, on the
Internet, or otherwise, prior to, during, or following the Contest. In all disputes, Sponsor is the sole judge and its actions are final and binding. Sponsor may announce any winner's name on-air or on its website. Sponsor, in its sole discretion, may disqualify any entrant from the Contest, refuse to award prizes and require the return of any prizes, if entrant engages in conduct Sponsor deems to be improper, unfair or otherwise adverse to the operation of the Contest or in any way detrimental to other entrants. Improper conduct includes, but is not limited to: falsifying personal information required to enter the Contest or claim a prize; violating any of these rules, accumulating points or prizes through unauthorized methods such as automated scripts or other automated means; tampering with the administration of the Contest or
trying to in any way tamper with the computer programs associated with the Contest; obtaining other entrants information and spamming other entrants; and abusing the Fantasy Sports Hour website in any way. Entrant further acknowledges that the forfeiture and/or return of any prize shall in no way prevent Sponsor from pursuing criminal or civil proceedings in connection with such conduct. Further NO CONTEST MAY BE USED FOR ANY FORM OF GAMBLING.
Sponsor reserves the right to modify these rules for clarification purposes without materially affecting the terms and conditions of the Contest. By entering into a Contest or accepting any prize, entrants, including but not limited to the winner(s), agree to release and to hold harmless Sponsor and Sponsor's Promotional Partners and each of their respective parents, subsidiaries, affiliates and agencies, as well as the officers, directors, employees, shareholders and representatives of any of the foregoing entities (collectively, the "Released Parties") from any and all liability, claims or actions of any kind whatsoever, including, but not limited to, for injuries, damages or losses to persons and property which may be sustained in connection with participation in the Contest, the receipt, ownership, use or misuse of any prize or while preparing for, participating in and/or travelling to or from any prize related activity, and claims based on publicity rights, defamation or invasion of privacy.
Sponsor and Sponsor's Promotional Partners are not responsible for: any incorrect, invalid or inaccurate entry information; human errors; postal delays/postage due mail; technical malfunctions; failures, including public utility or telephone outages; omissions, interruptions, deletions or defects of any telephone system or network, computer online systems, data, computer equipment, servers, providers, or software (including, but not limited to, software and operating systems that do not permit an entrant to participate in the Contest), including without limitation any injury or damage to any entrant's or any other person's computer or video equipment relating to or resulting from participation in the Contest; inability to access any website, or any web pages of the Sponsor; theft, tampering, destruction, or unauthorized access to, or alteration of, entries and/or images of any kind; data that is processed late or incorrectly or is incomplete or lost due to telephone, postal issues, computer or electronic malfunction or traffic congestion on telephone lines or transmission systems, or the Internet, or any service provider's facilities, or any phone site or website or for any other reason whatsoever; typographical, printing or other errors, or any combination thereof. Sponsor and Sponsor's Promotional Partners are also not responsible for incomplete, illegible, misdirected or stolen entries. If for any reason the Contest is not capable of running as originally planned, or if the Contest or website associated therewith (or any portion thereof) becomes corrupted or does not allow the proper entry to the Contest and processing of entries or points scored in accordance with these Rules & Regulations, or if infection by a computer (or similar) virus, bugs, tampering, unauthorized intervention, actions by
entrants, fraud, technical failures, or any other causes of any kind, in the sole opinion of Sponsor corrupts or affects the administration, security, fairness, integrity or proper conduct of the Contest, Sponsor reserves the right, in its sole discretion, to disqualify any individual implicated in such action and/or to cancel, terminate, extend, modify or suspend the Contest, and select the winner(s) from all eligible entries received. If such cancellation, termination, modification or suspension occurs, notification will be posted on the Fantasy Sports Hour website.
ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY PHONE SERVICE SITE OR WEBSITE (INCLUDING THE FANTASY SPORTS HOUR WEBSITE) OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
All entries become the property of Sponsor and will not be acknowledged or returned. Winners may be requested to provide Sponsor with proof that the winner is a resident at the address provided on the registration screen and that all eligibility requirements are met. In the event of a dispute as to the identity or eligibility of an entrant or winner based on an e-mail address, the applicable entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person 21 years of age or older who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, education institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail
address.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any entrant, Sponsor or the Released Parties in connection with the Contest, shall be governed by and construed in accordance with the laws of the State of Florida without giving effect to any choice of law or conflict of law rules or provisions which would cause the application of the laws of any jurisdiction other than the State of Florida. If any controversy or claim arising out of or relating to the Contest, the Official Rules, or the breach of any term hereof, cannot be otherwise resolved, it shall be resolved by binding arbitration conducted in Orange County, and administered by the American Arbitration Association (AAA).
Participation in the Contest must be made only as specified in these Official Rules. Failure to comply with these Official Rules will result in disqualification and, if applicable, prize forfeiture.
The failure of Sponsor to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of Sponsor (excepting compliance with applicable codes and regulations) or other force majeure event will not be considered a breach of these Rules & Regulations.
ADDITIONAL LEGAL RESTRICTIONS
Game of Skill
FANTASY SPORTS HOUR is a game of skill. Winners are determined by the objective criteria described in each contest's deadline, roster, and scoring rules. From all entries received for each contest, winners are determined by the individuals who use their skill and knowledge of relevant sports information and fantasy sports rules to accumulate the most points according to the corresponding scoring rules.
Contest Term
FANTASY SPORTS HOUR consists of contests during a designated interval of time.
Prizes
After each fee-based contest ends, prizes are awarded by 5:30 PM ET the following day. One 1st Place prize is awarded per fee-based contest. Prizes are added to the winning team's account balance. Prize calculations are based on the stats and scoring results as of the time of contest, the scoring results will not be changed regardless of any official stat scoring adjustments made by the leagues. No substitution or transfer of prize is permitted, except that Fantasy Sports Hour reserves the right to substitute a prize of equal value or greater if the advertised prize is unavailable. All prizes are awarded "as
is" and without warranty of any kind, express or implied, (including, without limitation, any implied warranty of merchantability for a particular purpose). All taxes associated with the receipt or use of any prize are the sole responsibility of the winner. A 30% U.S. income tax withholding will be applied to all non-U.S. prize winners. In the event that the awarding of any prizes to winners of the Contest is challenged by any legal authority, Fantasy Sports Hour reserves the right in its sole discretion to determine whether or not to award such prizes.
Withdrawal of Prizes
Winners are posted on the FANTASY SPORTS HOUR website and prizes are awarded to winners' Fantasy Sports Hour accounts after the conclusion of each contest by 5:30 PM ET on the following day. Winners may withdraw their cash prize awards as well as cash deposits by using the WITHDRAW FUNDS option under the MY ACCOUNT BILLING and MY ACCOUNT PRIZES sections of the FANTASY SPORTS HOUR website. Winners may be requested to complete an affidavit of eligibility and a liability/publicity release (unless prohibited by law) and/or appropriate tax forms in order to complete the withdrawal of their prizes. Failure to comply with this requirement can result in disqualification. Checks for withdrawal requests are processed every Friday and are sent via U.S. Mail. Fantasy Sports Hour may, from time to time, offer promotional deposits or credits to an entrants account for use in Contests. Promotional deposits and credits may not be withdrawn from a FANTASY SPORTS HOUR account.
